Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MindCast, operated by Alston Analytics (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

MindCast is an audio learning platform that transforms topics and documents into structured, narrated audio episodes. The Service includes:

  • Canon Library: A curated collection of pre-generated educational episodes available to all users at no cost.
  • Custom Episodes: On-demand AI-generated episodes from topics or documents you provide, subject to subscription limits.
  • Learning Features: Interactive quizzes, Socratic interludes, journal prompts, knowledge graphs, and other educational tools.
  • Share Engine: Tools to create and share audio clips and visual assets derived from episodes.
  • Embed Widget: An embeddable player that allows creators to distribute episodes on external websites.

All audio content on MindCast is generated by artificial intelligence. The Service uses AI models from third-party providers (including Anthropic, OpenAI, and Google) to research, write, fact-check, and narrate episodes.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. User Accounts

3.1 Account Creation

To access personalized features and custom episode generation, you must create an account using Google Sign-In (OAuth). Each person may maintain only one account. Creating multiple accounts to circumvent usage limits or for any other purpose is prohibited.

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the security and confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at info@alstonanalytics.com if you suspect unauthorized access

3.3 Account Deletion

You may delete your account at any time through your account settings or by contacting us. Upon deletion, your custom episodes and associated data will be permanently removed, subject to our data retention obligations described in our Privacy Policy. Unused Compute Pack credits are non-refundable upon account deletion.

4. Subscriptions and Payments

4.1 Free Tier

All users receive free, unlimited access to the Canon library of curated episodes. Free accounts may generate up to 3 custom episodes to experience the full AI pipeline.

4.2 Plus Subscription ($12.99/month)

Includes 30 minutes per month of custom episode generation, unlimited Canon library access, and all learning enhancements. Available with monthly or annual billing.

4.3 Pro Subscription ($29.99/month)

Includes 150 minutes per month of custom episode generation, premium voice selection, priority processing, debate format episodes, all export formats, and all features included in Plus. Available with monthly or annual billing.

4.4 Compute Packs

One-time credit purchases that supplement your monthly allocation. Compute Pack credits never expire and are consumed only after your monthly subscription minutes are depleted. Compute Packs are non-refundable.

4.5 Auto-Renewal and Cancellation

All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. Unused monthly minutes do not roll over between billing periods.

4.6 Price Changes

We reserve the right to modify subscription pricing. Existing subscribers will receive at least 30 days' written notice before any price increase takes effect. Continued use after a price change constitutes acceptance of the new pricing.

4.7 Refunds

Refunds are provided as required by applicable law. If you believe you have been charged in error, contact us at info@alstonanalytics.com within 30 days of the charge.

5. Intellectual Property

5.1 Canon Content

All Canon library episodes, including their scripts, audio, and associated learning materials, are owned by MindCast. You may listen to and share Canon episodes through the Service's built-in sharing features. You may not download, redistribute, or commercially exploit Canon content outside the Service without written permission.

5.2 Custom Episode Content

For custom episodes you generate, you receive a non-exclusive, non-transferable license to use the generated audio and text for personal, non-commercial purposes. Pro subscribers receive an expanded license that permits commercial use (e.g., embedding in presentations, podcasts, or educational materials), subject to attribution to MindCast.

5.3 User-Uploaded Documents

You retain full ownership of any documents, articles, or other materials you upload to the Service. By uploading content, you grant MindCast a limited, non-exclusive license solely to process that content for the purpose of generating your requested episode. We do not claim ownership of your uploaded materials, and we do not use them for any purpose other than fulfilling your request.

5.4 Your Topics and Prompts

You retain ownership of the topics, prompts, and instructions you provide to the Service. You grant MindCast a license to process this input to deliver the Service.

5.5 MindCast Platform

The MindCast platform, including its software, design, AI pipelines, algorithms, user interface, branding, and all underlying technology, is owned by Alston Analytics and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade dress.

6. Prohibited Uses

You agree not to use the Service to:

  • Generate content that is illegal, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Upload or submit copyrighted material for which you do not hold the rights or a valid license
  • Generate content that promotes violence, terrorism, hate speech, or discrimination against any group
  • Create misleading content designed to deceive or defraud others
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Attempt to circumvent usage limits, rate limiting, or subscription restrictions
  • Create multiple accounts to obtain additional free usage
  • Reverse engineer, decompile, or attempt to extract MindCast's AI models, algorithms, or source code
  • Use automated tools (bots, scrapers) to access the Service without written permission
  • Resell, sublicense, or commercially redistribute MindCast-generated content without the appropriate subscription tier and authorization
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Use the Service to generate content that infringes on the intellectual property rights of any third party

We reserve the right to suspend or terminate accounts that violate these restrictions, with or without prior notice.

7. AI-Generated Content Disclosure

7.1 Nature of Content

All episodes on MindCast, including both Canon and custom episodes, are generated by artificial intelligence. This means:

  • Content may contain factual inaccuracies, outdated information, or errors
  • AI-generated narration may not reflect the most current state of any topic
  • Content undergoes automated fact-checking but is not reviewed by human experts
  • Debate-format episodes present multiple perspectives for educational purposes and do not represent the views of MindCast or any real individual

7.2 Not Professional Advice

MindCast content is for educational and informational purposes only. It is not a substitute for professional advice of any kind, including but not limited to medical, legal, financial, tax, engineering, or psychological advice. Always consult a qualified professional before making decisions based on information from AI-generated content.

7.3 User Responsibility

You are solely responsible for verifying the accuracy and appropriateness of any information obtained through the Service before relying on it or sharing it with others.

8. DMCA and Copyright Takedown

8.1 Reporting Infringement

If you believe that content on MindCast infringes your copyright, you may submit a takedown notice to our designated agent. Your notice must include:

  1. Identification of the copyrighted work you claim has been infringed
  2. Identification of the material on the Service that you claim is infringing, with sufficient detail for us to locate it
  3. Your contact information (name, address, telephone number, and email address)
  4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
  6. Your physical or electronic signature

8.3 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification with: (a) identification of the removed material, (b) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake, (c) your name, address, and telephone number, and (d) a statement consenting to the jurisdiction of the federal court in your district. We will process valid counter-notifications in accordance with the DMCA.

8.4 Repeat Infringers

We will terminate the accounts of users who are determined to be repeat infringers.

9. Embed Widget and Third-Party Distribution

If you use the MindCast embed widget to distribute episodes on external websites, you agree to:

  • Use only embed codes and API keys provided through the Service
  • Not modify, tamper with, or remove branding from the embedded player
  • Not embed episodes on websites that contain illegal, harmful, or hateful content
  • Accept that MindCast may collect anonymous playback analytics from embedded players

We reserve the right to revoke embed access for any domain that violates these terms.

10. Termination

10.1 By You

You may cancel your subscription and delete your account at any time. Cancellation of a paid subscription takes effect at the end of the current billing period.

10.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You violate these Terms or any applicable law
  • Your use poses a security risk to the Service or other users
  • We are required to do so by law or a government order
  • Your account has been inactive for an extended period

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive (including intellectual property, limitation of liability, and dispute resolution).

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT GENERATED THROUGH THE SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALSTON ANALYTICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Alston Analytics and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you upload to the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall first be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms at any time. We will provide notice of material changes via email to your registered account address or through a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those changes.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alston Analytics regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet outages.
